7 Eleven Pest Analysis

On the first of January 1901 Australia became a federation when the Commonwealth of Australia Constitution Act came into force. Since this time, Australia has been a federated country, consisting of a Commonwealth Parliament and six State Parliaments. ? Whether or not all laws in Australia are made by the Federal Parliament.

The law in Australia is derived from 2 main sources: made by the Legislative Assembly (Parliament) and the decisions of the courts (the common law legal system). ? As time goes by, the law legal system in Australia become more and more perfect.

Australia is a federal country. Both federal and state has power to make laws legally. To ensure that each part of government is independent and in case that each branch act beyond its authority, various power should be exercised independently by each other. The role of the parliament in making laws is legislative power. Legislative power is the power to make laws. Both Federal and state parliament have their ability to make laws. Section 51 shows what each role of Federal and States in making laws.

The Australia constitution sets out law-making powers of the Commonwealth and provides for the division of law-making power between the Commonwealth and the States. (Business law principles book, page 21) Law-making power in a federal system can be classified in three way; Concurrent, Exclusive
